OFFICIAL SWEEPSTAKES RULES

1. SPONSOR AND SWEEPSTAKES DATES: The 12 Days of Giveaways from Leviton Sweepstakes for Leviton Manufacturing Co., Inc. (“Leviton”) (the “Sweepstakes”) begins on Sunday, December 1, 2019 at 12:01AM Eastern Standard Time (“EST”) and ends on Thursday, December 12, 2019 at 11:59 PM EST (the “Entry Period”). Entrants have a new chance to win daily prizes each day of the Entry Period, beginning at 12:01 AM EST and ending at 11:59 PM EST. By participating in the Sweepstakes, each participant unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of Leviton Manufacturing Co., Inc. 201 North Service Road, Melville, NY 11747 (“Sponsor” or “Leviton”), which shall be final and binding in all respects.
   
   ENTRIES WILL BE ACCEPTED ONLY FROM 12:01 AM EST ON DECEMBER 1, 2019 THROUGH 11:59 PM EST ON DECEMBER 12, 2019 (THE “ENTRY PERIOD”).
   
   All entries must be received prior to the end of the Entry Period. Proof of submission is not proof of entry or receipt by Sponsor. ALL ENTRIES MUST BE SUBMITTED IN ACCORDANCE WITH THESE OFFICIAL RULES. NO OTHER METHOD OF SUBMISSION WILL BE ACCEPTED. All incomplete, unreadable or unintelligible entries and any other entries not in compliance with these Official Rules will be disqualified. Sponsor shall have the absolute right to determine if an entry is in compliance with these Official Rules without notice to the person attempting to enter. False or deceptive entries or acts will render the entrant ineligible.
   
   ELIGIBILITY: Only legal residents of the United States and the District of Columbia who are at least 21 years old at the time of entry are eligible to enter into the Sweepstakes, except that if the total Approximate Retail Value (“ARV”) of all prizes in the Sweepstakes exceeds $500, individual legal residents of Rhode Island will not be eligible to enter. Sponsor, and its respective parent companies, subsidiaries, joint ventures, affiliates, successors, assigns and any other entities involved in the development, production, implementation, administration and fulfillment of the Sweepstakes, and each of their respective officers, directors, employees and representatives (collectively, the “Promotion Entities” and “Released Parties”), and the Immediate Family Members and Household Members of such individuals are ineligible to enter the Sweepstakes or win a prize. “Immediate Family Members” shall mean parents, step-parents, legal guardians, children, step-children, siblings, step-siblings or spouses. “Household Members” shall mean those persons (whether or not related) who share the same residence at least three (3) months a year. VOID WHERE PROHIBITED OR RESTRICTED BY LAW.
    
2. BY ENTERING THIS SWEEPSTAKES, EACH ENTRANT CERTIFIES THAT HE/SHE MEETS ALL ELIGIBILITY REQUIREMENTS AND AGREES TO ACCEPT AND BE BOUND BY ALL TERMS OF THESE OFFICIAL SWEEPSTAKES RULES.
    
3. APPROXIMATE RETAIL VALUE (“ARV”) OF ALL PRIZES TO BE AWARDED TO ALL WINNERS IS APPROXIMATELY TWO THOUSAND, ONE HUNDRED AND NINETY-NINE DOLLARS (US $2,199). It is solely the responsibility of the winner to install and ensure the safe installation of the prize. If you are unfamiliar with the proper installation of any or all of the awarded prizes, you should engage a professional electrical contractor. The ARV of the prize is subject to price fluctuations in the consumer marketplace based on, among other things, any gap in time between the date the ARV is estimated for purposes of these Official Rules and the date the prize is awarded or redeemed. Any difference between the ARV and the actual value of a prize will not be awarded to the winner.
    
4. This Sweepstakes is intended for play in the United States only and shall only be construed and evaluated in accordance with United States laws as set forth below. Do not enter the Sweepstakes if you are not located in the United States.
    
5. HOW TO ENTER: To enter the Sweepstakes, an eligible individual then must visit the website address announced through Leviton’s Facebook or Twitter accounts for that specific day’s sweepstakes and prizes, and fill in the corresponding Sweepstakes entry form (“Sweepstakes Entry”). By entering, you agree to accept the Sweepstakes’ Official Rules and Sponsor’s Privacy Policy. Each entrant may submit only one entry daily to enter for a chance to win that day’s prize during the Entry Period. Entry into the Sweepstakes is free.
   
   By submitting a Sweepstakes Entry, you consent to receiving direct messages and/or emails from Sponsor and/or its licensees and assignees, including but not limited to its agents, relating to the Sweepstakes. For Mobile Users, data rates may apply. You will be charged according to your mobile phone service provider's rate plans. Please consult your mobile phone service provider regarding rate plans.
    
5. LIMITED TO 1 ENTRY PER PERSON PER DAY DURING THE ENTRY PERIOD. More than one entry per day will not be accepted. Any attempt to make more than the stated number of Sweepstakes Entries by any method may void all Sweepstakes Entries from that entrant. If multiple, similar Sweepstakes Entries are received from any person/e-mail address/handle for the same entrant, only the first such Sweepstakes Entry received will be eligible for entry.
   
   Incomplete Sweepstakes Entries, including but not limited to those Sweepstakes Entries that do not address the requirements set forth in these Official Rules, will not be eligible. Proof of posting/sending does not constitute proof of actual receipt by Sponsor for purposes of these Official Rules. Sweepstakes Entries generated by script, macro or other automated or improper means and Sweepstakes Entries made by any means which subvert the participation process will be void in Sponsor’s sole discretion. By entering the Sweepstakes, Entrants fully and unconditionally agree to be bound by these Official Rules and the decisions of the Sponsor, which will be final and binding in all matters relating to the Sweepstakes.
    
6. PRIZE: There are 38 prizes in total. Leviton will mail each winner a single prize that will be determined by a random drawing for each day’s entries (each day from 12:01 AM EST to 11:59 PM EST of the Entry Period). The prizes for each day’s drawing are as follows:

   In the event that the selected winner of the prize is ineligible or refuses the prize, the prize will be forfeited and Sponsor, in its sole discretion, may choose whether to award the prize to another entrant in the Sweepstakes.
    
7. PRIZE AWARD PROCESS: There will be 38 prize winners total. Up to 1 week after the completion of the Entry Period, up to 4 winners will be randomly chosen each day from all entries submitted (as specifically described in the Prize section above), limit 1 prize per person, per day. The winner will be randomly chosen and the procedure for choosing the winner will be fair and impartial. Potential winners will be notified via email. If a potential winner is found to be ineligible or not in compliance with the Official Rules, cannot be reached or fails to respond to any notification attempt within the time period specified by Sponsor, fails to complete and return any required paperwork, affidavit, or release, fails to accept the prize, or if any attempted notification or prize delivery is returned as undeliverable, the potential winner may be disqualified and an alternate winner selected. If the Sponsor wishes to select an alternative winner, Sponsor will select this alternative winner at random from amongst all eligible Entrants.
    
8. WINNER DETERMINATION AND NOTIFICATION: The Prize will be awarded to the person named on the applicable entry subject to verification of eligibility of entrant and the validity and/or originality of their Submission and the terms of these Official Rules. In the event of a dispute as to the identity of an entrant, entrant will be deemed the Authorized Account Holder of the email address submitted at the time of entry. For purposes of these Official Rules, “Authorized Account Holder” shall mean the natural person who is assigned to the email address by an Internet service provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted email address. Proof (to Sponsor’s satisfaction in its sole and absolute discretion) of being the Authorized Account Holder may be required by Sponsor. It is solely the responsibility of the entrant to notify Sponsor in writing if the entrant changes entrant’s email address during the Entry Period.
    
9. PRIZE CLAIM PERIOD: Time is of the essence in awarding prizes. Accordingly, if a potential winner or the potential winner’s guest fails or refuses to timely sign and return any and all applicable prize Claim Documents, the potential winner may be disqualified and an alternate winner selected from the remaining eligible entries.
    
10. ODDS OF WINNING: Odds of winning a prize are a function of a number of factors, including, but not limited to, the number of eligible entries received. Precise odds of winning are therefore unavailable. ARV of the prize is subject to price fluctuations in the consumer marketplace based on, among other things, any gap in time between the date the ARV is estimated for purposes of these Official Rules and the date the prize is awarded or redeemed. Any difference between the ARV and the actual value of a prize will not be awarded to the winner.
     
11. CONDITIONS OF PARTICIPATION, LICENSE TO USE and LIABILITY RELEASE: By participating in the Sweepstakes, each entrant agrees: (i) to be contacted by Sponsor or Sponsor’s designees via telephone, email and/or postal mail regarding the Sweepstakes; (ii) that Sponsor and Sponsor’s designees shall have the right (but not the obligation) to use, print, publish, reproduce, distribute, display and publicly perform participant’s name, image, likeness, photos, voice, statements, biographical materials and/or other attributes of entrant’s identity (“Likeness”) in any manner whatsoever on and through any Media (including, without limitation, in online postings of the winner’s name, if applicable) throughout the world and in perpetuity for advertising, marketing and promotional purposes, without additional compensation, notification or permission, except where prohibited by law; and (iii) that entrant releases, discharges, indemnifies and holds the Released Parties harmless from and against any liability for any damages, injury or losses (“Losses”), to any person (including death) or property, of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize awarded to entrant pursuant to this Sweepstakes, entrant’s participation in this Sweepstakes or any Sweepstakes related activities, or from Sponsor’s and/or Sponsor’s designees’ use of entrant’s Submissions or Likeness in the manner permitted herein (including, without limitation, any Losses relating to claims based on intellectual property infringement, defamation or violation of the rights of privacy, publicity or moral rights). All applicable federal, state and local laws and regulations apply.
    
    Sweepstakes Entries by automatic, programmed or like methods will be disqualified. Improper, incomplete, mutilated and illegible entries will be disqualified. This Sweepstakes is subject to all federal, state and local laws. Sponsor reserve the right to disqualify any individual who tampers with the entry process or the website, attempts to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception or other unfair playing practices (including the use of automated quick entry programs), intends to annoy, abuse, threaten or harass any other entrants or Sponsor or otherwise acts in a disruptive manner. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
     
12. SPONSOR’S RIGHT TO TERMINATE THIS SWEEPSTAKES: If, in Sponsor's opinion, there is any suspected or actual evidence of fraud, electronic or non-electronic tampering or unauthorized intervention with any portion of this Sweepstakes, or if fraud or technical difficulties of any sort (e.g., computer viruses, bugs) compromise the integrity of the Sweepstakes, the Sponsor reserves the right to void suspect submissions and/or terminate the Sweepstakes and award the prize in its sole discretion. The use of any automated launching or entry software or any other mechanical or electronic means that permits the participant to automatically enter or evaluate repeatedly is prohibited. In the event of a dispute as to the identity of an entrant based on an email address, the entry in question may be disqualified subject to the Judges’ discretion.
     
13. IDENTIFICATION OF WINNERS/OFFICIAL RULES: To obtain a copy of the Winners’ List for this sweepstakes, send a self-addressed, stamped envelope to Winners’ List Request, The 12 Days of Giveaways from Leviton Sweepstakes, Attn: RESI Marketing Department, 201 North Service Road, Melville, NY 11747. All such requests must be received no later than 6 weeks after the end of the Entry Period. Vermont residents may omit return postage. These Official Rules will be posted on the Sweepstakes Home Page during the Entry Period and for 6 weeks thereafter. For a copy of these Official Rules, you can download them here, or visit the Sweepstakes Home Page by visiting the website address provided in any of the social media posts advertising the Sweespstakes.  
     
14. PRIVACY AND PERSONAL INFORMATION: By entering the Sweepstakes, you grant the Promotion Entities permission to share and otherwise use your email address, postal address, phone number and other personally identifiable information for the purposes and within the context of the Sweepstakes (including, without limitation, for administration, promotion and prize fulfillment) and for Sponsor’s marketing communications, which you may opt out of at any time. Such personally identifiable information may also be used by the Promotion Entities in order to verify a participant’s identity, postal address, and email address or otherwise verify the participant’s eligibility to participate in the Sweepstakes. Personally identifiable information will be used by the Promotion Entities exclusively for the purposes stated herein, in accordance with the Sponsor’s privacy policy posted at http://www.leviton.com/en/privacy-policy. By participating in the Sweepstakes, entrants hereby agree to Sponsor’s collection and usage of their personal information and acknowledge that they have read and accepted Sponsor’s Privacy Policy.
     
15. LIMITATIONS OF LIABILITY: The Released Parties shall not be responsible or liable for any: (i) losses, damages or other injuries of any kind resulting from entrant’s participation in the Sweepstakes or any Sweepstakes-related activity or from entrant’s acceptance, receipt, possession, use and/or misuse of any prize(s); (ii) incomplete, inaccurate, illegal, illegible, damaged, stolen, garbled, delayed, late, lost, misdirected, misrouted, mutilated, postage due or undeliverable, unintelligible or scrambled entries, emails, information, affidavits, releases or communications regardless of method of transmission; (iii) error, omission, interruption, defect, delay in or failed transmission, or interrupted or unavailable network, server or other connections; (iv) miscommunications, failed or malfunctioning computer hardware or software or technical failure; (v) printing, typographical, human administrative or technological errors appearing in these Official Rules or any screen shots thereof or in any other Sweepstakes related content or materials; (vi) other errors or problems of any kind whether mechanical, human, computer, electronic, mail or otherwise; or (vii) claims for invasion of privacy, rights of publicity, trademark or copyright infringement, defamation, negligent or intentional affliction of emotional distress. The Promotion Entities assume no responsibility for any injury or damage to any person’s computer, computer system, computer software or hardware, handheld or wireless device, or other property resulting from participating in the Sweepstakes or use of the Sponsor’s website. The Promotion Entities make no warranty, representation or guarantee, express or implied, in fact or in law with respect to the prizes. Sponsor reserves the right, in its sole discretion to disqualify any individual who is found to be tampering with, disrupting or undermining the participation process or the operation of the Sweepstakes or to be acting to annoy, abuse, threaten or harass any other person, in an unsportsmanlike manner or otherwise in violation of these Official Rules, and the Promotion Entities reserve the right to seek damages and other remedies from any such person to the fullest extent permitted by law. In the event Sponsor is prevented from awarding any prizes or continuing with the Sweepstakes as contemplated herein due to causes beyond Sponsor’s control (including, but not limited to, war, strikes, acts of God, computer viruses, worms, bugs, technical failures, tampering, hacking, fraud, unauthorized human intervention, public health crisis, federal, state or local government law, order or regulation or court or judicial order) then, subject to any governmental approval which may be required, Sponsor shall have the right to suspend, modify or terminate the Sweepstakes. Should the Sweepstakes be terminated prior to the end of the Entry Period, Sponsor reserves the right to award prizes based on eligible entries received before the date of such termination. These Official Rules cannot be modified or amended in any way except in a written document issued in accordance with applicable laws by a duly authorized representative of Sponsor. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision and in the event any such provision is determined to be invalid or unenforceable, these rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein. Sponsor’s failure to enforce any provision of these Official Rules shall not constitute a waiver of such provision or any other provision of these Official Rules.
    
    In addition, if the Sweepstakes is promoted on Facebook, Twitter, or Instagram, such social media platforms are released from liability by each entrant. Entrant and Sponsor also acknowledge that this Sweepstakes is not sponsored, endorsed, or administered by or associated with Facebook, Twitter, or Instagram.
     
16. DISPUTE RESOLUTION: Except where prohibited by law, by entering the Sweepstakes, each entrant agrees that: (i) any and all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes shall be governed by and construed exclusively in accordance with the laws of the state of New York without giving effect to any choice of law or conflicts of law rules of any jurisdiction; (ii) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prizes awarded in connection with the Sweepstakes shall be resolved individually without resort to any form of class action, and exclusively by the state and/or federal courts located in Suffolk County, New York; (iii) entrant hereby irrevocably submits to the jurisdiction of such courts; (iv) entrant waives any objection and shall not make any objection to the venue of any such action or proceeding in said courts or that such action or proceeding was brought in an inconvenient court; (v) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but shall in no event include attorneys’ fees; and (v) under no circumstances will any entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and to have damages multiplied or otherwise increased. By entering this Sweepstakes, ENTRANT WAIVES ANY RIGHT TO HAVE A JURY PARTICIPATE IN RESOLVING ANY DISPUTE, whether sounding in contract, tort, or otherwise, arising out of, in connection with, related to, or incidental to, this Sweepstakes.
     
17. GENERAL PRIZE CONDITIONS: All details and other restrictions of prizes not specified in these Official Rules will be determined by Sponsor in its sole discretion. No winner can transfer, assign or redeem for cash their prize or any component of the prize. No substitutions will be allowed, except Sponsor reserves the right to substitute prize(s) of comparable value (as determined by Sponsor in its sole discretion) if a prize listed or any component of a prize listed is unavailable for any reason. If for any reason, Leviton’s website or any third party social media websites fail or are unable to be utilized by any contestants, no substitute prize or additional compensation will be awarded and the winning entrant and Sponsor will have no further obligations to such winning entrants. Sponsor may award a different prize, in its sole discretion, if it does not receive a sufficient number of eligible entries. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Sweepstakes promotional or informational materials and the terms and conditions of these Official Rules, these Official Rules shall prevail and govern. Each winner shall be solely responsible for all federal, state and/or local taxes resulting from acceptance of the winner’s prize and the reporting consequences thereof. All other costs and expenses not specifically described herein as part of the prize are solely the responsibility of the respective winners.
